Dave Jochnowitz

Dave Jochnowitz is Co-Chair of Outten & Golden LLP’s Whistleblower & Retaliation Practice, with a particular focus on matters involving the SEC, CFTC, and IRS whistleblower programs. He counsels clients in False Claims Act cases alleging fraud against the government, and in retaliation matters brought under Dodd-Frank, Sarbanes-Oxley, New York Labor Law 740, and other whistleblower protection laws, advising executives on how to effectively report fraudulent schemes. His representation in notable cases has helped achieve hundreds of millions of dollars for plaintiffs. Dave serves as Chair Emeritus of The Anti-Fraud Coalition (TAF) Member Education Committee, is a member of its Financial Frauds Member Education Committee, and is a frequent writer and speaker on key issues in whistleblower law. Dave received his J.D. from Harvard Law School.

Is the SEC’s Whistleblower Program Distorting Enforcement?

Using a proprietary dataset, Dave Jochnowitz, Steven Singer, and Mona Birjandi analyze trends in the Securities and Exchange Commission’s whistleblower program. They find that sanctions have concentrated in a select few violation categories, raising the possibility that the program is structurally guiding enforcers to focus on certain violation types to the neglect of others.
